The tenderer shall visit the site before filling the tender. Work done claim shall be made as and when funds are made available. The executing agency shall not be held responsible for delay in payment due to non-release of funds. The work to be executed as per allocated funds on a yearly basis and do not give price escalation. The award of contract shall be subject to accord of administrative approval and technical sanction. If the lowest tenderer quotes rates below the advertised cost, the contractor should furnish performance security deposit in the form of FDR. The contractor must procure materials (cement, steel) from authorized dealers as per approved specifications. Quality must be verified and approved by the assistant executive engineer before commencement. Red Cross fees are applicable based on the contract value. The date of start of the work shall be reckoned within one week from the issuance of the LOI/contract allotment. Penalty for delay in completion of the work beyond the stipulated time will be imposed up to 10% of the contract value. No mobilization/equipment advance shall be paid. On completion of the contract, the contractor shall be responsible for removing all unused materials and restoring all work to its original position at their own cost. The contractor shall be responsible for the safety of all activities at the site of work and any damage to public property. The contractor shall be solely responsible for carrying out the mandatory tests required for quality control at their own costs. No attorney shall be entertained. Insurance cover for labor, machinery, work, plant, material, and equipment by the contractor is mandatory. The contract shall be governed by the laws of the land. The jurisdiction in case of any disputes between the contractor and the department shall be the JK state, Ladakh. The contractor is bound to adhere to traffic regulations and ensure arrangements for smooth traffic regulation during the execution of work.
