If any tenderer withdraws his tender or makes any modification in the terms conditions of the tender which is not acceptable to the department within 3 days after last date of submission of bids, then the government shall without prejudice to any other right or remedy, be at liberty to forfeit 50 of the earnest money absolutely irrespective of letter of acceptance for the work is issued or not.
