The time allowed for execution of the works as specified in the schedule f or the extended time in accordance with these conditions shall be the essence of the contract. The execution of the work shall commence from such time period as mentioned in schedule f or from the date of handing over of the site, notified by the engineerincharge, whichever is later.

The defect liability period shall be twentyfour 24 months from the date of completion of the facilities or any part thereof unless specified otherwise if during the defect liability period any defect should be found in the design, engineering, materials and workmanship of the plant and equipment supplied or of the work executed by the contractor, the contractor shall promptly, in consultation and agreement with the employer regarding appropriate remedying of the defects, and at its own cost, repair, replace or otherwise make good as the contractor shall, at its discretion, determine such defect as well as any damage to the facilities caused by such defect, to the satisfaction of the employer.
The officer inviting tenders shall have the right of rejecting all or any of the tenders and will not be bound to accept the lowest or any other tender.
The enlistment of the contractors should be valid on the last date of submission of bids. in case the last date of submission of bid is extended, the enlistment of contractor shouldbe valid on the original date of submission of bids.
If the contractor fails to maintain the required progress in terms of clause 5 or to completethe work and clear the site on or before the contract or justified extended date of completionas per clause 5 excluding any extension under clause 5. 5 as well as any extension grantedunder clauses 12 and 15, he shall, without prejudice to any other right or remedy availableunder the law to the government on account of such breach, pay as compensation theamount calculated at the rates stipulated below as the authority specified in schedule fmay decide on the amount of accepted tendered value of the work for every completed daymonth as determined that the progress remains below that specified in clause 5 or that thework remains incomplete.
The bidder may inspect the site on any working day and may contact for any query ortechnical clarification to executive engineer e rdss head of department.
The contractor shall, at his own expense and without delay supply to the engineerin charge samples of materials to be used on the work and shall get these approved in advance.
