But all such intermediate payments shall be regarded as payment by way of advance against the final payment only.

The contractor shall deliver the materials on or before the date mentioned in the tender failing which recovery will be made from the contractor as agreed liquidated damages equivalent to of the price of any storessupply which the contractor fails to deliver within the period fixed for delivery in schedule for each week or part of week.
