The successful bidder will be expected to complete the works by the intended completion period specified in the bid documentnotice.

The employer will award the contract to the bidder whose bid has been determined to be substantially responsive to the bidding documents and who has offered the lowest evaluated acceptable bid price, provided that such bidder has been determined to be: a. eligible in accordance with the provisions of clause 2 and b. qualified in accordance with the provisions of clause 3.

The bidders shall be eligible to participate only if they fulfill the qualifying criteria laid down separately hereinafter.

If the contractor fails to complete the work and clear the site on or before the date of completion or extended date of completion, he shall without prejudice to any other right or remedy available under the law to the company on account of such breach, pay as compensation liquidated damages: i @half percent of the contract amountrevised contract amount excluding gstwhichever is less, per weekor part of the week of delay. orii of the contractvalue excluding gstof group of items revised completion value ofgroup of items whichever is less, per weekor part of the week of delay for which a separateperiod of completion is originally given.

The bidder, at the bidders own responsibility, cost and risk, is encouraged to visit and examine the site of works and its surroundings, approach road, soil condition, investigation report, existing works, if any, connected to the tendered work, drawings connected to the work, if as available and obtain all information that may be necessary for preparing the bid and entering into a contract for execution of the works.
