The bidder warrants that the goods and services supplied under this contract shall have no defect arising from quality of the paint or workmanship or from any act or omission of the supplier, that may develop under normal use of the supplied goods in the conditions obtaining in the country of final destination. The tenderer must have experience in executing stenciling work for at least one exporter whose turnover is not less than 50 crores. Bidder should submit document proof for proving his expertise in doing stenciling work for any exporter with an annual turnover not less than 50 crore. The technical committee will evaluate the documents submitted by the bidder and his expertise in doing this work.

If the tenderer commits any breach of the tender conditions, FOMIL can without any notice forfeit the EMD. Non-performance of contract or quality of work below required specifications, or deliveries not made in accordance with the required timeframe, may lead to contract cancellation and blacklisting.
