In the event of the successful agency defaults in maintaining the agreed timeframes/scheduled set of activities as laid down in the contract, ESG shall have the right to cancel the contract at any time and make alternative arrangement at the discretion of ESG, in which case extra expenditure involved, will be recovered from the successful agency and the successful agency shall be liable to pay liquidated damages subject to a maximum of 20 of the total work order amount as an agreed preestimate of the damages suffered, considering the execution of the work carried out executed by the successful agency.

The applicant will be required to give a detailed presentation to the tender opening committee for which purpose the applicant will in addition to the audio visual presentation, bring the samples of the tote bags, merchandise, mementos, lanyards, and souvenirs.

The total work must be ready by 5:00 PM on November 10, 2025, for final inspection by concerned authorities of ESG. If any deficiencies are noticed, the bidder is responsible for making necessary corrections to the satisfaction of ESG before November 12, 2025, by 5:00 PM.

The payment to the agency will be as per actual work done and as per the evaluation of work done by the officer in charge subject to bills/invoice certification by the events section of ESG. At the time of effecting the payment, the TDS shall be deducted in terms of section 194c of the income tax act as amended from time to time.

The applicant shall have a cumulative gross turnover of INR 20 lakhs or more for the last three financial years (**** to ****) and other compliances as detailed in annexure I duly certified by a chartered accountant. The agency should have completed 3 similar works during the last 3 financial years. The relevant work orders of the work stated in annexure II shall be submitted in annexure III. The agency should submit bank details as per annexure IV. Employee, general body committee members, executive council members, tender committee members, technical audit committee members, or any other committee members constituted by ESG and their families (spouse and children) shall not be eligible to bid for the tender. If the bidder is a public limited company or private limited or partnership firm, the bidder shall produce the copy of the board members/partners duly self-attested. In the event the applicant is an MSME, the applicant shall produce a valid and updated Udyam registration.

Appropriate penalty may be imposed on the agency for minor deficiencies. In the case of significant deficiencies and errors in services causing adverse effect on the work, including on financial losses and/or reputation of ESG, appropriate penalty and/or other penal action including debarring for a specified period may also be initiated. The agency shall be penalized for any damage to the property of ESG.
